Office of Title IX

The Office of Title IX serves students, faculty and staff to ensure UPIKE’s commitment to uphold a zero tolerance policy for sexual misconduct (sexual assault, dating violence, domestic violence, sexual harassment, sexual exploitation and stalking) and discrimination based on sex.

What Is Title IX?

Title IX is a comprehensive federal law that prohibits discrimination on the basis of sex in any federally funded education program or activity. Title IX promotes equity in academics and athletics programs, preventing hostile environments on the basis of sex and sexual misconduct.

The Title IX Coordinator oversees the investigation and resolution of complaints of discrimination, sexual harassment and sexual violence (sexual assault, dating violence, domestic violence, sexual exploitation and stalking).

The Office of Title IX ensures that all cases are handled with equal care and concern and with equity of due process. The Office of Title IX also provides training to students, faculty and staff to increase awareness and to help prevent sexual misconduct. Training is also provided to all investigators, hearing officers and appeals officers to ensure that the investigation and adjudication process protects the safety of survivors and promotes accountability.

What is Consent?

Consent is clear, knowing and voluntary permission. It is the responsibility of each person involved in sexual activity to ensure that they have the affirmative consent of the other party to engage in sexual activity. When alcohol or drugs have been used, the person is considered to be unable to give valid consent if they cannot fully understand the details of the sexual interaction (who, what, when, where, why or how). Consent cannot be assumed from silence or prior sexual relationship with the person. Consent does not ever come from the use of force, coercion or incapacitation.
