Federal Student Aid Ombudsman

The Federal Student Aid (FSA) Ombudsman of the U.S. Department of Education helps to resolve disputes and mediate problems with federal student loans. The FSA Ombudsman encourages borrowers to make every effort to resolve their student loan problems. When a solution cannot be reached by either the servicer or the borrower, the FSA Ombudsman has a process to resolve the problem.

Student Loan Code of Conduct

UPIKE supports and complies with the Higher Education Opportunity Act (HEOA) provisions regarding the code of conduct required to be adopted and enforced by institutions participating in the Title IV loan program. All UPIKE employees with responsibilities for the administration of student educational loans are informed annually of the provisions of the Student Loan Code of Conduct.

Student Loan Code of Conduct Purpose

UPIKE recognizes that ensuring the integrity of the student financial aid process is critical to providing fair and affordable access to higher education and has formalized the following guiding principles. These guidelines are designed to help avoid any potential for a conflict of interest between the university, and its students or their parents, in the student financial aid process. For purposes of this code of conduct, a lending institution is any entity (other than an institution of higher education or a governmental entity such as the U.S. or Kentucky Department of Education) involved in the making, holding, consolidating or processing of any student loans.

Policy

UPIKE employees shall receive no personal benefit. No employee or officer of UPIKE shall accept or solicit anything of more than nominal value on his or her behalf or on behalf of another person or entity from any lending institution. Specifically, no employee or officer of UPIKE shall accept or solicit, from any lending institution:

(i) payment for entertainment expenses or any lodging, rental, transportation or other gratuities related to lender-sponsored activities; (ii) payments for registration, transportation or lodging at lender-sponsored conferences and training; and (iii) solicitations or invitations to serve on lender advisory boards and/or payments related to such service.

Additionally, UPIKE employees and officers shall not accept or solicit, from any student loan guarantee agency: (i) payments for entertainment expenses or any lodging, rental transportation or other gratuities related to activities sponsored by the guarantee agency.

UPIKE employees shall not serve on lender advisory boards for remuneration. No officer or employee of the university who makes financial aid decisions for the university or who is employed in, supervises or otherwise has responsibility or authority over UPIKE’s financial aid office shall receive any remuneration for consulting services and/or serving as a member or participant of a student loan advisory board of a lending institution or any reimbursement of expenses for such service. Any officer or employee of UPIKE who serves as a member or participant of a lending institution’s board shall recuse himself or herself from any board discussions regarding the university’s financial aid operations.

UPIKE shall not provide any advantage to a lending institution. The university shall not accept anything of value from any lending institution in exchange for any advantage or consideration provided to the lending institution related to its student loan activities, including but not limited to revenue-sharing, printing costs or below-cost computer hardware or software. Likewise, UPIKE shall not allow any lending institution to: (a) staff the university’s financial aid office at any time; or (b) communicate with the university’s students or their parents in such a manner as to create the impression that the lending institution is an employee or agent of the university in connection with the university’s student financial aid operations, including through the use of mascots, logos and other marks. Finally, UPIKE shall not enter into any agreement with a lending institution to provide alternative (i.e., private, non-federal or opportunity) student loan programs if the provision of such alternative loan programs prejudices other students or parents, or if the acceptance of such funds by the university is conditioned on the university providing concessions to the lending institution.

UPIKE shall make appropriate use of any preferred lender lists. If the university decides to promulgate a list or lists of preferred or recommended lenders for student loans or similar ranking or designation (preferred lender list), the selection of lending institutions for inclusion on the preferred lender list shall be based on the best interests of the university’s students and their parents without regard to the financial interests of the university. In addition, any preferred lender list shall clearly indicate:

• That UPIKE shall not steer borrowers to particular lenders. Nor shall it refuse to certify or delay the certification of any loan based on the borrower’s selection of a particular lender or guaranty agency. Students and their parents are free to select the lending institution of their choice and will suffer no penalty imposed by the university for using a lending institution that is not a preferred lender. Further, for any first-time borrower, the university shall not assign, through the award packaging or other methods, the borrower’s loan to a particular lender;
• That students and their parents are not required to use any of the preferred lenders;
• Where to find information on their lending institutions for student loans;
• That UPIKE will promptly certify any loan from any lending institution selected by a borrower, in accordance with U.S. Department of Education Regulations;
• The process UPIKE utilized to select preferred lenders, including but not limited to the criteria used and the relative importance of such criteria.

UPIKE shall review any preferred lender list on an annual basis to determine that the information appearing on the list is accurate and that any website links are still available.


Higher Education Emergency Relief Fund

The University of Pikeville received $783,266 in Higher Education Emergency Relief Fund – Emergency Financial Aid Grants to Students from the Department of Education. The university has received and signed the Department’s Certification and Agreement and has awarded, to date, $783,266 (100 percent of funds) to students. To facilitate the awarding of funds and the required reporting, the funding was applied to student accounts and the full amount refunded to them.

The university had two rounds of funding.

In the first round, funding was awarded to 967 students and was based on student expected family contribution (EFC) and Pell eligibility. The information was taken from student FAFSAs. Student awards varied depending on whether students displayed full, partial or no Pell eligibility.

In the second round, students submitted applications that included essays demonstrating their need. A committee scored these applications on a scale of one to five based on severity of need (i.e. one point for savings, tuition for next term, second apartment, etc., five for illness, more extreme needs); 274 students received awards in this round of funding.

Students received instructions, directions, or guidance via email concerning the Emergency Financial Aid Grants. Approximately 90 percent of students at the institution were eligible to receive funds.

Final Report

The University of Pikeville received $783,266 in Higher Education Emergency Relief Fund – HEERF II – Coronavirus Response and Relief Supplemental Appropriations Act Grants (CRRSAA) to Students from the Department of Education. The university has received the Department’s Supplemental Certification and Agreement and has awarded, to date, $783,100 (99 percent of funds) to students. To facilitate the awarding of funds and the required reporting, the funding was applied to student accounts and the full amount refunded to them.

Funding was awarded to 1,773 students and was based on Pell eligibility. The information was taken from student FAFSAs. All undergraduate, graduate and professional level students were included, with the exception of international students.

CRRSAA-HEERF II and ARP-HEERF III – Student Portion – Reporting

The University of Pikeville received $783,266 in Higher Education Emergency Relief Fund – HEERF II – Coronavirus Response and Relief Supplemental Appropriations Act Grants (CRRSAA) to Students from the Department of Education. In addition, UPIKE received $2,446,952 in HEERF III – American Rescue Plan funds for students. The university has received the Department’s Supplemental Certification and Agreement and has awarded, as of March 31, 2022, $3,168,225(98 percent of funds) to students. To facilitate the awarding of funds and the required reporting, the funding was applied to student accounts and the full amount refunded to them.

HEERF II-CRRSAA funding was awarded to 1,773 students and was based on Pell eligibility. The information was taken from student FAFSAs. All undergraduate, graduate and professional level students were included, with the exception of international students. HEERF III-ARP funding was awarded in November 2021 to 2,237 students including spring and summer 2021 UPIKE graduates and was based on PELL eligibility. Students were informed by via email that funds were being distributed.

The University of Pikeville received a total of $4,013,484 in Higher Education Emergency Relief Funds (HEERF, HEERF II, HEERF III) grants for students from the U.S. Department of Education. As of June 2023, all funds designated for students have been distributed.

The Funding Certification and Agreement for the Institutional Portion of the Higher Education Emergency Relief Fund (HEERF) was signed and returned on April 24, 2020. Pursuant to the agreement, the University of Pikeville was awarded $783,265. All funding received to date has been expended and allocated as designated in the reporting documents (links included below).

The funding for the Institutional Portion of the Higher Education Emergency Relief Fund – Coronavirus Response and Relief Supplemental Appropriations Act (CRRSAA – HEERF II) was awarded December 27, 2020, by Congressional approval and execution by the president of the United States. Pursuant to the agreement, the University of Pikeville was awarded $1,973,573, the institutional portion of the funding. Funding received to date has been expended and allocated as designated in the reporting documents (links included below for CRRSAA).

Campus Public Safety

The UPIKE Department of Public Safety is dedicated to enhancing the opportunity for students, faculty and staff to participate in the educational experience by providing a safe, protected and orderly environment. The safety of our students, faculty, staff and visitors is of primary importance. The Public Safety Department seeks participation by all members of the university family and provides you with direct contact with officers and personalized services as we enforce university rules and regulations.

As a service organization, the department offers a full range of security resources, including preventative patrols (24 hours), criminal investigations, crime prevention, facilities security, special event services and parking management and enforcement.

The department also serves the UPIKE community by providing safety analysis for the campus, hazard inspections and personal escorts. The Public Safety Department further strives to ensure the safety of the university family by offering several interactive teaching sessions related to safety and security of the students, faculty and staff.
